Definitions

• “Us” or “we” or “Barber” refer to The Torquay Barber and anyone representing The Torquay Barber

• “The Torquay Barber” refers to The Scarlett Company Pty Ltd AFT The Scarlett Trust Trading as The Torquay Barber

• “Client” or “you” refers to the client who engages with The Torquay Barber for purchases of products or services including persons visiting www.thetorquaybarber.com.au or www.thetorquaybarber.com

• “Booking system” refers to the third party system, Fresha (www.fresha.com), which The Torquay Barber uses to make and manage client bookings

• “No show” is when a client does not attend their scheduled appointment

• “Media content” refers to photographs or videos being used as is or in an adjusted format

Website, Instagram, Fresha

The Torquay Barber may make changes to the information on our website, social media site(s) or to services described on any platform, at any time and without notice. The Torquay Barber may change, move, delete or add content to any website or platform used for The Torquay Barber business purposes.

Booking system

The Torquay Barber uses a third party booking platform, Fresha, to manage its client bookings. To review Fresha’s terms and conditions and privacy policy, please visit their website directly (https://www.fresha.com).

If a client calls to make a booking, makes a booking in person, emails hello@thetorquaybaber.com.au or sends a text message to The Torquay Barber to make a booking, the client gives The Torquay Barber permission to create an account/and or profile and booking, using the clients personal details, by adding required information into the booking system, Fresha.

Bookings

The Torquay Barber reserves the right to cancel any booking or refuse any services, at anytime, we will immediately notify this action by email, phone or in person.

No show and late to appointments

When a client does not attend 3 or more of their scheduled appointments, The Torquay Barber, to its discretion can refuse future bookings and/or advise all future bookings must be made over the phone, in-person or via email.

If you are more than 10 minutes late to your appointment, The Torquay Barber reserves the right to adapt the service to suit the remaining appointment time or cancel and/or reschedule the appointment.

Products and services

The Torquay Barber may use and sell hair products supplied by third parties. The Torquay Barber is not liable for any injury or damages caused through the use or purchasing of these products.

The Torquay Barber is not liable for any injury or damages caused through the use of of the The Torquay Barber services.

Sales are final on products and services, no refunds are accepted.

The Torquay Barber maintains the rights to have any client removed from any premises where The Torquay Barber is functioning from for any reason The Torquay Barber deems necessary.

The Torquay Barber may terminate any services at anytime.

The Torquay Barber reserves the rights to refuse any appointment/booking.

The Torquay Barber may provide links to other websites, but is not responsible for the content of such websites and shall not be liable for any damages or injury arising from that content.

We are not responsible for the privacy practices of other websites/businesses. We encourage you to review the Privacy Policies of such websites/businesses. 

Photo release

The Torquay Barber may request to take photographs and videos of you for promotional purposes before, during and/or after a service. Verbal permission given by you is legal and binding. You may decline. If approval is given, The Torquay Barber has permission to use photographs and videos as is or part of content creation to be used for promotional purposes on mediums such as, but not limited to, social media platforms, websites, printing and other means of advertising. Your consent gives The Torquay Barber ownership rights to the media content (photographs and videos). In no circumstances will royalties or other payments be due to the individual who has been captured in photographs or videos. The Torquay Barber is not responsible for any injury or damages that may be caused in relation to the use of approved photographs and/or videos.
